Terms and Conditions of Use

1. Owner identification

This website and the BestViews.ai platform (hereinafter, "the Platform") is owned by Altoclick S.L., with Tax ID ESB64562044, registered address at C/ Cecs de la Boquería 4, 3º A, 08002 Barcelona, Spain, and contact email: [email protected].

2. Purpose

These Terms and Conditions govern access to and use of the Platform, which provides AI-powered real estate photo enhancement services, including but not limited to: lighting enhancement, virtual home staging, image cleanup, interior redesign, perspective correction, stylization, 3D floor plans, and resolution upscaling (hereinafter, "the Services").

3. Registration and user account

To use the Services, the user must create an account providing truthful and up-to-date information. The user is responsible for maintaining the confidentiality of their login credentials and for all activities carried out under their account.

Upon registration, the user receives 20 free credits to try the Services. The use of these credits is subject to these Terms.

4. Credit system and plans

The Platform operates on a credit system. Each tool consumes a specific number of credits per use. Available subscription plans and credit packages, along with their prices, are detailed on the Platform's pricing page and may be updated periodically.

Credits acquired through subscription plans are renewed monthly and are not cumulative between periods, unless otherwise stated. Credits acquired through packages do not expire as long as the account remains active.

5. Payments and billing

Payments are processed through Stripe. By subscribing to a plan or purchasing credits, the user accepts Stripe's terms of service. Prices include VAT where applicable. Subscriptions renew automatically unless previously cancelled.

The user may cancel their subscription at any time from their dashboard. Cancellation will take effect at the end of the current billing period.

6. Intellectual property

The user retains all rights to the original images uploaded to the Platform. Images processed by the Services are owned by the user and may be freely used for commercial and professional purposes.

The brand, design, code, and content of the Platform are the property of Altoclick S.L. and are protected by applicable intellectual and industrial property laws.

7. Acceptable use

The user agrees to:

• Use the Platform only for lawful and legitimate purposes.
• Not upload illegal, offensive, defamatory content or content that infringes third-party rights.
• Not attempt to access restricted areas of the Platform or perform reverse engineering.
• Not use the Platform to generate misleading content that could harm potential buyers or tenants.
• Not share login credentials with third parties.

8. Limitation of liability

The Platform is provided "as is." Altoclick S.L. does not guarantee that the Services will be uninterrupted or error-free. Image processing results using AI may vary and are subject to the inherent limitations of the technology.

Altoclick S.L. shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform, to the maximum extent permitted by law.

9. Image storage

Uploaded and processed images are stored temporarily to provide the Services. Images are automatically deleted 30 days after processing. The user may manually delete their images at any time.

10. Modifications

Altoclick S.L. reserves the right to modify these Terms at any time. Significant changes will be communicated to the user by email or through a notice on the Platform. Continued use of the Platform after notification constitutes acceptance of the new Terms.

11. Termination and suspension

Altoclick S.L. reserves the right to suspend or cancel accounts that violate these Terms or that misuse the Platform, with prior notification to the user when possible.

12. Applicable law and jurisdiction

These Terms are governed by Spanish law. For any dispute arising therefrom, the parties submit to the Courts and Tribunals of Barcelona, without prejudice to any rights that may correspond to the user as a consumer under applicable regulations.
